Check-ins

KindRideShare.net is a digital media communications tool dependant upon the reliability of user connectivity and willingness to participate. To maintain membership, users must comply with the following minimum requirements.

(1) Incomplete profiles cannot be accessed by visitors, meaning no one can see or community with the member. Each member is minimally required to provide insight into their interests, personality, and culture.

(2) Profiles that remain incomplete for more than 30 days are considered abandoned and scheduled for removal.

(3) Members should expect to receive monthly check-in requests, to ensure their lines of communication are open to the community.

(4) Accounts that do not respond to check-in requests are placed in hibernation and cannot be accessed by visitors until the owner's next log in.

(5) Accounts that are in hibernation for more than 6 months are scheduled for removal.

(6) Deleted accounts cannot be recovered but the user may join again in the future.

(7) Email addresses and/or cellular numbers associated with abandoned accounts cannot be used to create a new account in the future. Members are advised to delete their account instead

(8) Members wishing to remain anonymous until they post in the rideshare may set their Privacy Settings to Me Only, after they have completed their profile.

KindRideShare.net LLC retains the right to delete any and all illegal and/or abusive content that user's post on its pages, to include private areas, as well as to filter or delete any content from being displayed to others that violates these terms and conditions. For the protection of the ride sharing community joining this website, KindRideShare.net LLC further retains the right to store and share any and all information concerning abuse and the person(s) causing the abuse.

Account Security

KindRideShare.net LLC is only responsible for the security of its domain names, DNS records, server, data storage systems, and website(s).  Each user is responsible for the security of their own account.

KindRideShare.net uses what are called "session cookies" to authenticate users as they surf the website.  Once these cookies expire or are deleted, the user is automatically logged out and taken to the log in page.

Session cookies delete themselves after a user logs out of their account or closes their web browser. However, there is always a chance these cookies remain allowing anyone using your device access your account. For this reason, always make sure you clear your history and close your browser before walking away.

Please observe the following advice to keep your account secure:

  2. Change your password often.

  6. If available, always use two-step verification.  Of course, this too would not be effective if you shared the device where you receive the two-step verification code.

In addition to the user's responsibility in securing their account, KindRideShare.net LLC does protect against brute force attempts to break into accounts.

Terms and Conditions of Use

By using KindRideShare.net Website (the "Website") you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member"). If you wish to become a Member, communicate with other Members, and make use of the KindRideShare.net service (the "Service"), you must read these Terms of Use and indicate your acceptance of them by following the instructions in the Registration process.

This Agreement sets out the legally binding terms of your use of the Website and your membership in the Service. Until such time KindRideShare.net is able to employ an adequate staff of international coordinators and compliance monitors, only citizens of the United States of America may access the website and/or become a member at this time. United States citizens must be of the legal age of consent within the jurisdiction where they reside to register as a member or use the Website. Membership in the Service is void where prohibited. By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

2. Term.

This Agreement will remain in full force and effect while you use the Website and/or are a Member. You may terminate your membership at any time, for any reason, by following the instructions on the Desktop pages, or upon receipt by KindRideShare.net. KindRideShare.net may terminate your membership at any time and for any reason, effective upon sending notice at the email address or SMS number provided in your Desktop. If KindRideShare.net terminates your membership in the Service because you have breached the Agreement, you will not be entitled to any refund of unused subscription fees. Even after membership is terminated, this Agreement will remain in effect. Even after this Agreement is terminated, certain provisions will remain in effect, including sections 4, 5, 7 and 9-14 of this Agreement.

3. Non Commercial Use by Members.

Standard membership (free account) is for the personal use of individual Members ONLY and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses must register through the KindRideShare.net subscription service. Illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or hot linking to any digital content hosted at the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and/or injunctive redress.

4. Proprietary Rights in Content on KindRideShare.net.

KindRideShare.net owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other proprietary information of KindRideShare.net, and its licensors. Except for any personally generated information and that which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, and/or sell any such proprietary information. At no time may you, by any means, access the raw scripting code developed to create, host, and deliver KindRideShare.net to the World Wide Web. You understand and agree that KindRideShare.net may review and delete any content, messages, KindRideShare.net Mail Messenger messages and forum postings, to include photos and other digital media as well as any member profile data (collectively, "Content"), that in the sole judgment of KindRideShare.net violate this Agreement or which might be illegal under the laws of the State of Colorado and/or the United States of America. All other content, to include content unsuitable for the general public or persons of special interest, is considered as expressions of personal culture and therefore protected under the First Amendment of the United States Constitution. Providing any content posted does not violate any law of the aforementioned jurisdictions, KindRideShare.net will not remove any such content or delete any Member account based on third-party opinion even if it conveys a strong message not suitable for general viewing. To do otherwise would fly in the face of KindRideShare.net's loyalty to the fundamental principles of free expression as protected by the constitutions of the State of Colorado and the United States of America.

b. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service, or transmit to other Members.

c. By posting Content to any viewing area of KindRideShare.net, you automatically grant, and you represent and warrant that you have the right to grant, to KindRideShare.net and its viewers an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses to such content.

d. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. KindRideShare.net reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the illegal communication from the Service and terminating the membership of such violators. It includes Content that:

1. involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";

2. promotes information that you know is false, misleading or promotes illegal activities;

4. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

5. provides instructional information about illegal activities such as making or buying illegal weapons or providing or creating computer viruses;

6. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and

7. engages in any commercial activities and/or sales without KindRideShare.net's prior written consent.

e. You must use the Service in a manner consistent with any and all applicable laws and regulations applicable within the jurisdiction where you are located at the time you access KindRideShare.net.

g. Standard Members joining under a free account may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although KindRideShare.net cannot monitor the conduct of its Members off the Website, it is also a violation of these terms to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, KindRideShare.net reserves the right to restrict the number of messages which a Member may send to other Members in any given time period which KindRideShare.net deems appropriate in its sole discretion.

All KindRideShare.net users must respect the copyrights in works that are accessible through computers connected to the KindRideShare.net network. Federal copyright law prohibits the reproduction, distribution, public display or public performance of copyrighted materials without permission of the copyright owner, unless fair use or another exemption under copyright law applies. In appropriate circumstances, KindRideShare.net will terminate the network access of users who are found to have repeatedly infringed the copyrights of others.

7. Subscription.

KindRideShare.net offers two (2) subscription program services:

a. Standard - Only individuals who are accessing KindRideShare.net for the purpose of getting connected in a carpool or rideshare may register for and maintain a Standard membership account. There are no fees or term limitations for the standard use of KindRideShare.net providing such use is by a human using their own hands. Any given user may only register and maintain one (1) account. Accounts that are dormant for at least twelve (12) months will be deactivated until reclaimed.

b. Paid - Only individuals who are accessing KindRideShare.net for the purpose of networking for a carpool or rideshare and who wish to contact an unlimited number of members may hold and maintain a paid membership account. Paid Membership costs $3.50 per month, billable in cycles of one (1) year ($42), and only entitles the Member to unlimited access to the communications tools offered by the Service. All other privileges granted under the KindRideShare.net Standard account remain unaffected.

8. Member Disputes.

You are solely responsible for your interactions with other KindRideShare.net Members. KindRideShare.net reserves the right, but has no obligation, to monitor disputes between you and other Members.

9. Privacy.

Use of the Website and/or the Service is also governed by the KindRideShare.net Privacy Policy.

10. Disclaimers.

KindRideShare.net is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with the Service, whether caused by users of the Website, Members, or by any of the equipment or programming associated with or utilized in the Service by Members. KindRideShare.net is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. 15. Drug and Alcohol Free.

KindRideShare.net maintains a strict, zero tolerance Drug and Alcohol policy. At no time may an entity or entities known to promote the manufacturing, sales, distribution, and/or illegal consumption of mind altering and/or intoxicating substances may publish, use, promote, brandish, and/or send referrals from any forum or population may access KindRideShare.net. At no time will a Member consume or have possession of any illegal substance(s) that may pose a threat to the safety of the ridesharing community. Users must also understand that in some states, such as the State of South Dakota, citizens can be criminally charged for "Possession by Consumption." This means even the use of marijuana with detectable levels within the fluids produced by the body is a crime in that state which threatens the rideshare community. For those who violate this policy, it is important to understand that the use and/or promotion of KindRideShare.net or any part of its brand to any population that may threaten the safety of the ridesharing community is not a matter of the DMCA but rather one of safety and security.

16. Other.

This Agreement, accepted upon use of the Website and further affirmed by becoming a Member of the Service, contains the entire agreement between you and KindRideShare.net regarding the use of the Website and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
